1. The agreement

These Terms of Service ("Terms") are a binding agreement between you and Website Monitor AI LLC, the operator of Website Monitor at websitemonitor.ai ("we", "us", "the Service"). By creating an account, by clicking a button that references these Terms, or by using the Service in any way, you accept them. If you use the Service on behalf of a company, you represent that you are authorised to bind that company, and "you" means the company.

If you do not agree with these Terms, do not use the Service.

You must be at least 18 years old, or the age of majority where you live, to use the Service. The Service is intended for professional and business use, including monitoring websites you run for your own clients.

2. What the Service does, and what it does not promise

The Service periodically sends HTTP requests to the URLs you register ("monitors"), records the result, and notifies you through the channels you configure when a result looks like an outage. It also lets you publish status pages and view history and statistics.

Monitoring is a best-effort, probabilistic activity. You acknowledge and agree that:

  • Checks run at intervals (currently every 5 minutes on Free and every 1 minute on Pro). Outages shorter than an interval may not be detected, and detection is never instantaneous.
  • A check reflects what our servers could reach at that moment from their location. Your site may be reachable to us and down for your users, or the reverse. False positives and false negatives can happen.
  • Notifications depend on third parties (email providers, chat platforms, mobile carriers, your own inbox rules). We do not guarantee that any notification is delivered, or delivered on time.
  • The Service does not fix, host, back up, or secure your websites. It observes them.
  • Uptime percentages, response times and other statistics are computed from our own samples and are estimates, not audited measurements.

We may change, add or remove features, check locations, intervals and limits at any time. Where a change materially reduces what a paid plan includes, we will give reasonable notice.

3. Your account

You need an account to use the Service. Give us accurate information and keep it current. You are responsible for everything that happens under your account and for keeping your password and API keys secret. Tell us immediately through the Support form if you suspect unauthorised access.

One person or company per account. You may not share credentials, sell or transfer an account, or create accounts for the purpose of evading limits or a suspension.

4. Acceptable use

You may only add monitors for websites and endpoints that you own, operate, or are explicitly authorised to monitor (for example a client who hired you to look after their site). You are solely responsible for having that authorisation.

You agree not to:

  • Use the Service to overload, probe, scan or attack any system, or to monitor a target that has asked not to be monitored.
  • Monitor content that is illegal, or use the Service in connection with any illegal activity.
  • Reverse engineer, scrape, resell or white-label the Service, or access it by any means other than the interfaces we provide (the web app, documented API and status pages).
  • Bypass, disable or interfere with rate limits, plan limits, security or anti-abuse measures, including the human verification on public forms.
  • Submit false, misleading or abusive messages through the Support form or any other channel.

"Unlimited" monitors on Pro means we do not count them for ordinary use. To keep the Service fast for everyone it carries a fair-use ceiling (currently 250 monitors per account), checked at intervals no shorter than the plan allows. If you reach it, contact us and we will raise it for legitimate use. Automated or abusive patterns may be throttled or suspended without notice.

5. Plans, prices and payment

The Free plan currently includes up to 3 monitors at 5-minute intervals and email alerts. It is free of charge. We may change its limits or features, or discontinue it, at any time.

Pro is a paid subscription billed in advance, monthly or yearly, in US dollars, through our payment processor Stripe. Prices are shown on the pricing page at the time of purchase and exclude any taxes, which may be added where required by law. By subscribing you authorise us and Stripe to charge your payment method at the start of each billing period until you cancel.

Founding price. The first 100 paying accounts receive the launch price shown on the pricing page. That price stays locked for as long as the subscription remains continuously active. If the subscription lapses, is cancelled, or payment fails and is not resolved within the grace period Stripe allows, the lock ends and any new subscription is at the then-current price.

Price changes. We may change Pro prices for new subscriptions at any time. For existing subscriptions that are not price-locked we will notify you at least 30 days before a change takes effect. Continuing to use the Service after the change means you accept the new price.

14-day money-back guarantee. If Pro is not for you, ask us within 14 days of your first payment and we will refund that payment in full. The guarantee applies once per customer, to the first payment only. Renewals and later payments are non-refundable except where the law requires otherwise. Refunds go to the original payment method.

Cancellation. You can cancel at any time from the Billing page. Cancellation takes effect at the end of the current billing period, you keep Pro until then, and you are not charged again. We do not prorate partial periods.

Failed payments. If a charge fails we will retry and email you. If it is not resolved, your account returns to the Free plan and monitors above the Free limit are paused (not deleted) until you upgrade again or remove them.

6. Suspension and termination

You may close your account at any time from Settings. Closing it deletes your monitors, status pages and personal data as described in section 10.

We may suspend or terminate your access, in whole or in part, with or without notice, if we reasonably believe you have breached these Terms, if your use creates risk or legal exposure for us or others, if required by law, or if you have not paid. Where practical we will warn you first and give you a chance to fix the problem.

If we terminate for your breach, you are not entitled to a refund. If we discontinue the Service entirely or terminate your paid plan for our own convenience, we will refund the unused part of any prepaid period.

Sections that by their nature should survive (payment obligations, disclaimers, limitation of liability, indemnity, governing law) survive termination.

7. Third-party services

The Service relies on providers we do not control, including Stripe (payments), Resend (email), Cloudflare (DNS, human verification) and Hetzner (hosting). Their outages or policy changes may affect the Service. Your use of those providers through the Service is also subject to their own terms. Integrations you connect (such as Slack, Discord or Telegram webhooks) are governed by those platforms.

8. Intellectual property

We own the Service, its software, design, brand and content. These Terms give you a limited, non-exclusive, non-transferable, revocable licence to use the Service in line with them. We do not claim ownership of the URLs, names and settings you enter, or of your websites.

If you send us feedback or suggestions, we may use them without obligation to you.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT EVERY OUTAGE OF YOUR WEBSITES WILL BE DETECTED, OR THAT ANY NOTIFICATION WILL BE DELIVERED. YOU USE THE SERVICE AT YOUR OWN RISK.

The Service is not a substitute for your own operational monitoring, backups, security controls or professional judgement, and it is not designed for use where a failure to detect or notify could lead to death, personal injury, or severe physical or environmental damage.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA OR CUSTOMERS, ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS, INCLUDING FROM DOWNTIME OF YOUR WEBSITES, A MISSED OR DELAYED DETECTION, A MISSED OR DELAYED NOTIFICATION, A FALSE ALARM, OR INACCURATE STATISTICS, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY, EVEN IF WE WERE ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY US DOLLARS (USD 50).

Some jurisdictions do not allow certain exclusions or limitations. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including non-waivable rights you may have as a consumer under the laws of your state or country of residence.

11. Indemnity

You will defend, indemnify and hold us harmless from any claim, demand, loss, liability, damage, cost or expense (including reasonable legal fees) arising from your use of the Service, your monitors or status pages, your breach of these Terms, or your violation of any law or of the rights of a third party, including monitoring a website without authorisation.

12. Privacy and data

This section explains what we collect and why. It forms part of these Terms.

What we collect:

  • Account data: name, email address, hashed password, plan, language preference, and the alert channels you configure (for example a Slack webhook URL or a phone number).
  • Monitoring data: the URLs you add, their settings, and the result of every check (timestamp, HTTP status, response time, error text). Raw check logs are kept for a limited period and then aggregated into statistics.
  • Billing data: handled by Stripe. We store your Stripe customer and subscription identifiers and the type of payment method (for example "card ending 4242" or "Link"), never full card numbers.
  • Security and usage data: IP address, browser user agent, and an activity log of significant account actions (login, password reset, plan changes, admin actions) so we can secure accounts and investigate abuse.
  • Support data: when you use the Support form we store the message, your name and email, the page you were on, your IP address and the result of the human verification, and we send you a copy by email.

How we use it: to run the Service, send the alerts and emails you asked for, bill you, answer your messages, keep the Service secure, meet legal obligations, and improve the product. We do not sell personal data and we do not use it for third-party advertising.

Processors: Hetzner (hosting, Germany/Finland), Stripe (payments), Resend (transactional email), Cloudflare (DNS and human verification). Each processes data only to provide its service to us.

Cookies: we use a session cookie to keep you logged in and a cookie to remember your language. No third-party tracking cookies.

Public information: status pages you create are public by design, including the monitor names and statuses you choose to show on them. Public platform statistics shown on our site (such as total checks performed) are aggregated and never identify you or your sites.

Retention: account data is kept while your account exists and deleted within 30 days after you close it, except billing records we must keep for tax and accounting purposes, and security logs kept for a limited period to investigate abuse. Support messages are kept for up to 24 months.

Your rights: you can view and update your data in Settings, export your check logs from each monitor, and delete your account yourself. For any other request about your personal data (access, correction, deletion, portability, objection), or to reach our data protection contact, use the Support form or write to the address in section 15. We honour rights under the GDPR, the California Consumer Privacy Act and comparable laws, and we do not sell your personal data.

13. Changes to these Terms

We may update these Terms. When we do, we will change the "effective" date at the top and, for material changes, notify you by email or with a notice in the app at least 14 days before they take effect. If you keep using the Service after that, you accept the updated Terms. If you do not, close your account before the effective date.

14. Governing law and disputes

These Terms are governed by the laws of the State of Kansas and the federal laws of the United States, without regard to conflict-of-law rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising from these Terms or the Service will be brought exclusively in the state or federal courts located in the State of Kansas, and you consent to their personal jurisdiction and venue, except where mandatory consumer-protection law gives you the right to sue where you live.

Before filing a claim, you agree to contact us through the Support form and give us 30 days to try to resolve the matter informally.

To the extent permitted by law, you and we agree that any dispute will be resolved on an individual basis only. You waive the right to participate in a class action, collective action or representative proceeding against us, and the right to a jury trial.

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a right is not a waiver of it. These Terms, together with the pricing page and any plan-specific terms we publish, are the entire agreement between us about the Service.
